📝 EHCP LEGAL TIMEFRAMES – and why they’re o 📝 EHCP LEGAL TIMEFRAMES – and why they’re often ignored ⏳

If you’re in the EHCP process, you might have heard that it should take 20 weeks from start to finish (from the request to final plan). That’s the legal deadline.

But here’s the thing 👉 many Local Authorities (LAs) miss it. A lot.
Why?

💬 Here’s why they often don’t stick to the rules: 
➡️ Understaffed teams
➡️ Rising demand for SEND support
➡️ Poor communication & processes
➡️ Lack of accountability

But guess what? The law doesn’t change just because the LA is overwhelmed.
If your timeline’s slipping, you can challenge it. Knowing your rights is powerful 💪

⚖️ Quick Breakdown of EHCP Timeframes: 
🔹 6 weeks – LA must decide whether to assess
🔹 16 weeks – LA must decide whether to issue a plan
🔹 20 weeks – Final EHCP must be issued (from original request)

⏰ Delayed? Keep everything in writing. Ask for updates. And don’t be afraid to escalate.

💛 You’re not alone — and knowledge is your armour.
You can’t just deregister your child from a spec You can’t just deregister your child from a specialist school like you can from a mainstream one — and it’s not okay.

This is not something I was aware of when I fought for Sam’s place and I wish I had known this before looking at all the options available…

If your child has an EHCP and attends a specialist school, you’re legally not allowed to deregister them and home educate without the local authority’s permission. Yes, even if it’s not working. Even if it’s damaging their mental health. Even if you have a full plan ready to support them at home.

This isn’t about safeguarding. It’s about control.

Parents of neurodivergent children deserve the same rights as any other. We know our kids best — and we should have the freedom to act in their best interest without begging the system for permission.

Let’s talk about this. Let’s change it.
So this morning I got a notification to say an aut So this morning I got a notification to say an automated payment had been taken from my account for the total of £178 for a subscription I had no idea I was paying 😳 

When I checked it was for an app on my phone that I didn’t realise I was even paying for, never mind that this amount had come off annually for the last three years 😩😩😩😩 I hate ADHD tax, this month so far I’ve:

• lost an introductory credit card transfer rate due to a late payment
• paid £178 for an app I don’t use 
• ended up in my overdraft with 2 weeks till payday due to my inability to budget effectively

But, I’ve also managed to look at my monthly budget so I can go back to cash stuffing which works really well for me.

I’ve made over £100 so far listing all the clothes and shoes I no longer wear on Vinted. 

And I cancelled that app subscription to ensure I don’t pay again next year!
